Small Business Relief: is it actually worth electing?

Most articles on Small Business Relief stop at "you can elect". The useful question is whether you should — and for a business with losses, the answer is often no.

What the relief does

Where revenue for the tax period, and for every previous tax period, is at or below AED 3,000,000, a resident taxable person may elect to be treated as having no taxable income for that period. The election is made in the tax return, period by period — it is not a status you acquire once.

Note that the test is on revenue, not profit, and that it looks backwards as well: exceed the threshold in one period and the relief is not available in later ones.

The part that gets left out

Electing is not free. For a period in which you claim the relief you are treated as having no taxable income, which means there is no taxable loss to carry forward either. If your business made a real loss that year, electing throws away a deduction you could have set against a profitable year later.

The same logic applies to net interest expenditure that would otherwise have been carried forward.

So when is it worth it?

  • Worth electing: you are profitable but modestly so, and the compliance saving is real
  • Worth electing: your profit is comfortably under the AED 375,000 threshold anyway and you value the simpler return
  • Think twice: you made a loss this period that you could carry forward
  • Think twice: you have significant disallowed interest that would otherwise carry forward
  • Think twice: you are close to AED 3,000,000 and expect to cross it — the relief ends and the planning changes

It is a decision, not a default

Because the election is made period by period, the right answer can change from one year to the next in the same business. A year of losses followed by a year of profit is exactly the pattern where electing in the loss year costs more than it saves.

The calculation is not complicated, but it does have to be done — on your actual numbers, before the return is filed rather than after.

Availability of the relief runs to tax periods ending on or before 31 December 2026 as published. Check the current position before relying on it for a later period.
